COMPANY PRÉSENTATION

These General Conditions of Sale are concluded between on the one hand Safran La Nadalle, individual farm, registered under the number SIRET 82908718800019, located 46700 DURAVEL, represented by Mr Eric Darques Rose, and on the other hand any person having made a purchase with Safran a Nadalle, hereinafter referred to as "the Client"».

 

APPLICATION OF THE GENERAL CONDITIONS OF SALE

These general conditions of sale apply to all orders taken on the website http://www.safranlanadalle.fr. They are exclusive of any other purchase conditions of Customers, which cannot be invoked against Safran La Nadalle.

 

DESCRIPTION OF ARTICLES

Safran La Nadalle strives to present and describe its articles as precisely and as accurately as possible. However, any error or omission can not be attributed to Safran La Nadalle and under no circumstances may Safran La Nadalle be held liable for this reason. The photographs cannot be opposed to Safran La Nadalle, are non-contractual and are the property of Safran La Nadalle.

 

PRICE

All the prices presented are expressed in euros and all taxes included. The goods remain the full property of Safran La Nadalle until receipt of the total amount due paid by the Customer.

Any change in the applicable statutory VAT rate will be automatically reflected in the prices of the articles upon its entry into force.

 

VALIDITY  OF THE OFFER

The offers on the site are valid during their online presence. The geographic area of supply and delivery coverage is Metropolitan France, Corsica, Monaco and Andorra.

 

ORDERED

The order is validated once payment has been accepted by Safran La Nadalle. The Customer will receive an e-mail which will include the constituent elements of his order. Safran La Nadalle reserves the right to refuse an order if the Customer already presents a dispute with Safran La Nadalle or if Safran La Nadalle considers that the Customer poses a risk of default. Safran La Nadalle therefore reserves the right to ask the Customer for additional information (identity document or proof of address). Without a response from the Customer within 5 working days of the order, the order and payment will be canceled.

 

AVAILABILITY OF PRODUCTS

Safran La Nadalle undertakes to honor orders received, only while stocks last. If the products ordered are unavailable, Safran La Nadalle will inform the Customer as soon as possible by email or telephone. The Customer can then request reimbursement of the amounts paid or opt for a replacement product depending on availability. The definitive or temporary unavailability of a product cannot in any way engage the responsibility of Safran La Nadalle, any more than it can not open any right to compensation or damages in favor of the Client.

In all cases, Safran La Nadalle is released from its delivery obligations in the event of force majeure (fire, flood, strike, riot, etc.) or for reasons beyond its control.

 

PAYMENT

Safran La Nadalle has chosen the fully secure SystemPay payment solution: e-commerce with complete peace of mind.

This versatile and scalable platform is constantly adapting to new uses on the market and integrating all the technical expertise of NatixisPayment Solutions and Lyra Network. It is the guarantee of benefiting from an effective solution meeting all the requirements as well as those of the customers.

The Systempay platform is PCI-DSS certified, and has 3D-Secure and GIE Bank Card approvals as standard.

PCI DSS (= PaymentCard Industry Data Security Standard) is the security standard for the payment card industry. It is a data security standard for major payment card groups such as Visa, MasterCard, American Express, Discover and JCB.

Any attempt to pay is systematically accompanied by a request for authorization from the bearer's bank. This allows you to check the nature of the card, its validity date and whether it has not been declared stolen.

The information you provide on your bank card is saved directly and only on the company's server. In accordance with European Directive 95/46 / EC, all of this information remains confidential. Safran La Nadalle does not store any information relating to bank card payments..

 

DELIVERY OF ORDERS

Safran La Nadalle reserves the choice of transporter and commits to deliver to the client to the address indicated on the order form. Delivery is only available to France, Andorra and Monaco. When ordering, the client must state a delivery address (not a P.O. box) where delivery can be effected during opening hours. If desired the delivery address can differ from the invoice address. Saffon La Nadelle will inform the client of the delivery number of the parcel by email. The client must be present to receive the package and to verify the contents with the transporter. The products ordered travel at the risk of the Customer. Upon receipt of the package, the Customer must check the general appearance of the products and refuse any damaged package. Any dispute must be immediately made to the post office and to our services within 2 days of the presentation of the package.

The carrier delivery times are 2 to 5 working days. To this must be added the time required to prepare the order (2 to 5 working days). No shipment will be made on Saturdays, Sundays and public holidays. These deadlines are given for information only. Delivery times are the sole responsibility of the transporter. In no case shall Safran La Nadalle's responsibility be engaged in the event of non-compliance with delivery times.

Any delays cannot motivate either compensation, refusal of goods, or cancellation of the order.

The Customer can choose to send his order to his home or pick it up directly at the farm:

1) Standard Delivery

The delivery costs are calculated according to the total weight of the package, namely: products + packaging + handling costs.

2) Delivery of packages by Colissimo either at home, at a post office or at a Colissimo collection point

At your home: Your package is delivered to you personally or delivered to your post box. If its size does not allow delivery to the post box, it will be made available to you at your nearest post office You have 10 working days from the arrival of your package at the post office to collect it. After this time, it will be returned to sender. In all cases you are informed by email 24 hours before the delivery of your package.

Post office: You can choose the establishment to which you wish to have delivered (without prior receipt of your invoice at home) from the 10,000 post offices available throughout mainland France. Once the package has been prepared, it will be delivered within an indicative period of 48 hours and you will be informed of the availability of your package by SMS and e-mail. You can then pick it up within 10 working days. After this time, your package will be returned.

At a Colissimo collection point: You can choose one of the 7,500 local merchants in the Pickup network, close to your home, your place of work or vacation, to which you wish to have your delivery. Once the package has been prepared, it will be delivered within an indicative period of 48 hours and you will be informed of the availability of your package by SMS and e-mail. You can then pick it up within 10 working days. After this time, your package will be returned.

  RIGHT TO RETRACT

In accordance with the provisions of article L. 221-18 et seq. Of the Consumer Code, the customer has the right to withdraw, without giving any reason, within fourteen days. This withdrawal period expires fourteen days after the day on which the customer, or a third party designated by him for this purpose, physically takes possession of the last product ordered.

To exercise this right of withdrawal, the customer must notify Safran La Nadalle of his decision to withdraw by means of a letter sent by post or by email.

The product for which the Customer requests a refund must be intact, unopened and in its original packaging. The Customer must attach to the product (s), the order number concerned by the return, the designation of the product (s) concerned by the return and a RIB / RICE to the shipment. The mode of transportation must have a tracking number. Without a tracking number, Safran La Nadalle will not accept any complaints. Product returns are the responsibility of the Customer. Reimbursement will be made by bank transfer.

If the returned item is refused by Safran La Nadalle, it is returned to the Customer at the expense of Safran La Nadalle without the Customer being able to demand any compensation whatsoever.

 

EXCEPTIONS :

In accordance with the provisions of article L. 221-28 4 ° and 5 ° of the Consumer Code, the right of withdrawal does not apply to products liable to deteriorate or expire quickly, as well as to products which have been unsealed by the customer after delivery and which cannot be returned for reasons of hygiene or health protection.

 

GUARANTEES

Safran La Nadalle guarantees that the products delivered comply with current legislation and that they have been the subject of the most careful care before their packaging and dispatch which is carried out in such a way as to keep the perfect preservation of the products.

The contractual obligations of Safran La Nadalle are automatically suspended and the responsibility of Safran La Nadalle is released in the event of events likely to stop or reduce the production, the transport of goods or prevent the normal execution of sales. The transfer of risks occurs from delivery, the date from which the customer agrees to be responsible for the conservation of the product under normal conditions and compatible with their nature. The customer must in particular take care not to consume the products beyond the expiration date indicated on the label. Safran La Nadalle's warranty is limited to the replacement of goods recognized as defective, the customer having to, before use or consumption, check the goods. No return or replacement will be accepted after expiration of the consumption deadline.

 

In the event of a deterioration in the quality of the products, Safran La Nadalle will reimburse them. In this case, the customer must immediately return the package to Safran La Nadalle for verification. Safran La Nadalle cannot however guarantee that the products meet the personal taste expectations of those who consume them.

 

RESPECT FOR PRIVACY

Safran La Nadalle reserves the right to store Customer data. However, in accordance with the law n ° 78-17 of January 6, 1978, any Customer can oppose the commercial use of his data and has the right to access, rectify and delete data concerning him.

 

GENERAL COLLECTION AND USE OF DATA

When ordering, Safran La Nadalle records the Customer data in order to better process the order and proceed with the shipment of purchased products. This information is kept in order to comply with legal and regulatory obligations, as well as to personalise the offers. Thanks to the email address, Safran La Nadalle confirms the order and communicates with the Customer if necessary. The personal data collected by Safran La Nadalle is exclusively reserved for Safran La Nadalle and will never be transmitted to other companies.

 

INTELLECTUAL PROPERTY

All elements present on Safran La Nadalle documents, whether visual or text, are the exclusive property of Safran La Nadalle and are therefore protected by the Intellectual Property Code and Copyright. Any reproduction of Safran La Nadalle documents, partial or complete, is strictly prohibited. The distribution of documents presenting Safran La Nadalle products is authorized if it is carried out fairly and without this damaging the reputation of Safran La Nadalle. However, it is forbidden to establish a link suggesting a form of association with Safran La Nadalle if it does not exist.

 

LIMITATION OF LIABILITY

Safran La Nadalle cannot be held liable in the event of indirect damage, special damage or incidents resulting from the Customer's negligence, failure or clumsiness, or resulting from improper use by the Customer of one of the products sold by Safran La Nadalle.

 

APPLICABLE RIGHT

The Client fully accepts and recognizes that French law governs these General Conditions of Sale, as well as any dispute or dispute that may arise between the Client and Safran La Nadalle. In the event of difficulties in applying these General Conditions of Sale, the Customer and Safran La Nadalle are encouraged to find an amicable solution before any legal action.

In the event of failure of an amicable solution, any dispute arising from this contract will be brought before the competent courts.

 

MODIFICATION OF THESE TERMS

Safran La Nadalle reserves the right to modify and adapt the general conditions of sale at a later date.
